England and Wales Set November 6 Start for New Pornography Offences

New content offences taking effect next month require careful attention to what the legislation covers - and how material is possessed or shared.

New content offences taking effect next month require careful attention to what the legislation covers - and how material is possessed or shared.

Ministry of Justice guidance published on October 16 confirms that new pornography offences under the Crime and Policing Act 2026 commence on November 6, 2026, in England and Wales.

The specified categories concern explicit, realistic depictions involving strangulation or suffocation, certain familial relationships and people who appear to be, or are portrayed as, under 16. Publication offences carry a maximum five-year sentence. The territorial scope is not the whole United Kingdom.

Possession and publication extend beyond a website

The guidance explains that possession is a factual question involving custody or control and may include material retained in personal accounts or cloud storage.

Publication includes making an image available to another person by means such as sending, posting or sharing it.

The guidance also identifies statutory defences, including circumstances involving knowledge and legitimate reasons for possession or publication.

These qualifications are central to the legal scope, rather than incidental exceptions.

Why a broad headline is insufficient

A description such as “violent pornography ban” would leave important questions unanswered.

Counsel need to examine the specified depiction, the statutory definitions, the alleged act and any available defence. Possession and publication are separate activities requiring separate consideration.

The existence of material on a system does not, by itself, resolve every element of an offence.

What platforms and publishers should review

Organizations assessing exposure should identify relevant content categories, distribution functions and retention arrangements.

A useful review would connect legal analysis with the people responsible for moderation, storage, complaints and escalation. Policies should be understandable to those making operational decisions.

The commencement date also makes implementation planning important. Reviewing terms alone will not establish whether systems and staff follow them.

Canadian relevance

These offences do not establish Canadian criminal law. Canadian businesses operating services in England and Wales should nevertheless assess whether their activities engage the local rules.

The appropriate response depends on the service, content and applicable legal obligations.

The compliance deadline is clear. The legal assessment still requires precision about the material and the conduct.
