Google Cloud Outage Disrupts UK Courts and Tests Digital Resilience

A cloud outage can become a courtroom problem when participants depend on it to attend.

A cloud outage can become a courtroom problem when participants depend on it to attend.

Google Cloud’s October 20 disruption affected the video platform used for remote court proceedings in England and Wales, alongside other services. ITV: disruption to court video links.

The outage and the incident record

Google’s incident record attributes the outage to a power event in a London availability zone. It records a disruption lasting approximately eight hours, reports mitigation for most customers and promises a subsequent investigation report. Google Cloud: incident record.

The incident also prompted parliamentary scrutiny. The Treasury Committee asked the Bank of England and Financial Conduct Authority how they would use their powers under the critical-third-party regime. Google Cloud EMEA was among the providers designated under that regime in July. Treasury Committee: regulatory questions.

Those are related developments with distinct legal settings: disruption to court participation and oversight of suppliers critical to financial services.

A workable contingency process

For justice-system administrators, the immediate question is what happens when the designated attendance method becomes unavailable.

A workable contingency process should tell participants how to contact the court, how to establish that an outage prevented attendance and who decides whether the hearing can continue through another method.

For counsel, preparation includes keeping hearing details and essential contact information available outside the affected system. A backup that depends on the same unavailable service may offer little practical protection.

The incident also illustrates why a supplier’s broad geographic footprint does not, by itself, establish the resilience of a particular application. The relevant question is how that application is configured and what recovery arrangements have been tested.

Resilience depends on tested arrangements

Canadian courts and firms can draw a practical comparison without assuming the same systems or regulatory powers apply.

As the investigation develops, the important evidence will concern the failure, recovery and performance of contingency arrangements. The existence of an outage does not by itself establish a regulatory breach.

Digital access to justice depends on a credible plan for the day the connection fails.
