EU Court Sends KLM State Aid Case Back but Dismisses Condor Challenge

Two airline aid judgments went against Ryanair on November 5. Only one ended the challenge before the court. The Court of Justice of the European Union sent unresolved issues concerning €3.4 billion in Dutch aid to KLM back to the General Court. In a separate case over €321 million in German restructuring aid for Condor, it dismissed Ryanair’s action itself.

KLM: Who benefited from the aid?

The KLM dispute concerns a Dutch state guarantee on a bank loan and a state loan intended to provide liquidity during the pandemic. A key issue was whether KLM and its subsidiaries were the sole beneficiaries, or whether the analysis should also have included Air France and the group holding company.

The Court of Justice accepted the framework the General Court used to examine whether companies formed an economic unit. Its objection was to how the lower court applied that framework: it had substituted its own assessment without showing that the Commission’s conclusion was implausible. The Court set aside the annulment and dismissed part of Ryanair’s challenge. The remaining pleas go back for decision.

Condor: Was a formal investigation required?

In the Condor case, the dispute concerned whether the Commission should have opened a formal investigation before approving restructuring aid. The Court of Justice set aside the General Court’s judgment and dismissed Ryanair’s action against the approval decision. There was no remand in that case.

For competition counsel, the pair illustrates why the remedy matters as much as the headline result. Setting aside an annulment can leave unresolved grounds for another court to decide, or the appellate court can dispose of the action itself. Today’s KLM judgment narrows the litigation; the Condor judgment disposes of the challenge at issue.
